Terms of Service

1. Acceptance of Terms

By accessing or using FloorStrategy ("the Service"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service. These terms apply to all users including flooring contractors, retailers, and team members accessing the platform.

2. Description of Service

FloorStrategy is a software-as-a-service platform designed for flooring contractors and retailers. The Service includes estimating tools, job management, installer scheduling, client portals, AI blueprint takeoff, price list management, and related features. Features vary by subscription plan.

3. Accounts and Registration

You must provide accurate information when creating an account. You are responsible for maintaining the security of your account credentials. You must notify us immediately of any unauthorized access. We reserve the right to suspend accounts that violate these terms.

4. Subscriptions and Billing

FloorStrategy offers paid subscription plans billed monthly. By subscribing, you authorize FloorStrategy to charge your payment method on a recurring basis. Subscription fees are charged at the start of each billing period. Prices are listed on the pricing page and may change with 30 days notice to existing subscribers. Founder rates are locked for life for users who subscribed during the Early Access period.

5. Free Trial

New users may be eligible for a free trial period as described at signup. At the end of the trial, your payment method will be charged the applicable subscription rate unless you cancel before the trial ends. We reserve the right to modify or discontinue free trial offers at any time.

6. Cancellation

You may cancel your subscription at any time from your account settings. Cancellation takes effect at the end of the current billing period. You will retain access to the Service until the end of the paid period. We do not prorate partial months.

7. Refunds

Refunds are governed by our Refund Policy.

8. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose
• Attempt to gain unauthorized access to any part of the Service
• Reverse engineer, copy, or resell the Service
• Upload malicious code or interfere with the Service's operation
• Use the Service to store or transmit content that violates any law or third-party rights

9. Data and Privacy

Your use of the Service is also governed by our Privacy Policy. By using the Service, you consent to the collection and use of your data as described in the Privacy Policy.

10. Intellectual Property

FloorStrategy and its content, features, and functionality are owned by FloorStrategy and are protected by copyright and other intellectual property laws. You retain ownership of data you input into the Service.

11. Disclaimer of Warranties

The Service is provided "as is" without warranties of any kind, express or implied. FloorStrategy does not warrant that the Service will be uninterrupted, error-free, or free of viruses or other harmful components.

12. Limitation of Liability

To the maximum extent permitted by law, FloorStrategy shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service. Our total liability to you for any claims arising from these terms or your use of the Service shall not exceed the amount you paid us in the 12 months preceding the claim.

13. Governing Law

These terms are governed by the laws of the State of Washington, without regard to conflict of law principles. Any disputes shall be resolved in the courts of Washington State.

14. Changes to Terms

We may update these terms from time to time. We will notify you of material changes by email or by posting a notice in the Service. Continued use of the Service after changes constitutes acceptance of the updated terms.
